Studentawards Inc.’s (the “Contest Sponsor”) Forum Five Contest (the "Contest")

Official Contest Rules and Regulations


1. The Contest begins on March 4, 2008 at 11:59 a.m. (EST) and runs until April 15, 2008 at 11:59 a.m. (EST) (the "Contest Period").

2. No purchase is necessary to enter the Contest.

3. Any Studentawards Forum member who is a Canadian citizen or permanent resident of Canada, excluding residents of Quebec, is eligible to enter the contest. To enter the draw, a Studentawards Forum member must complete a “Contest Entry” by submitting five (5) valid posts to the Studentawards Forum. Fully and correctly completed Entries received by Studentawards Inc. within the Contest Period will generate a valid “Contest Entry”. Entries which are incomplete, illegible, damaged, irregular, or that contains false information, will not generate a valid “Contest Entry”.

4. The Contest prizes (the "Prizes") will consist of the following:
Description of Prizes: Five (5) cash awards
Approx. retail value per prize: $100 CND

5. The odds of winning a Prize depend on the number of eligible Contest Entries received during the Contest Period. Entries will not be eligible if not entered in accordance with these Contest Rules above or if not entered during the Contest Period.

6. The following other conditions apply to Prizes:
a. Only the listed Prizes will be awarded and no substitutions, cash equivalents or redemptions will be made, except that Studentawards Inc. reserves the right, in its sole discretion, to substitute for each non-cash Prize its cash value or a Prize of equal or greater retail value.
b. A Prize may not be transferred or assigned except if expressly consented to by Studentawards Inc.
c. Only one (1) Prize will be awarded per household.
d. Each Contest winner is responsible for all taxes, surcharges and fees associated with receipt or use of a Prize.
e. All charges and/or expenses, other than those specifically mentioned in Section 5 as part of a Prize are the responsibility of the winner of that Prize.
f. Other restrictions may apply.

7. Studentawards Inc. will not be responsible for any late, lost or destroyed Contest Entries, or for any online communication problems.

8. On or about April 22, 2008 at approximately 11:30 a.m. (EST), an appropriate number of Entry Forms will be drawn at random at the offices of Studentawards Inc. from all eligible Contest Entries received within the Contest Period in order to award each selected entrant a Prize (the "Contest Draw").

9. This online Contest is only open to registered Studentawards Forum members who are legal residents of Canada (void where prohibited by law), excluding residents of Quebec, and who have reached the age of majority in the province or territory in which they reside (or who provide proof of consent of his or her legal guardian) and are residing in Canada at the time of the Contest, except individuals associated with the Contest, including without limitation all employees, contractors, agents and representatives of Studentawards Inc., contest sponsor, its affiliated companies, their respective divisions, subdivisions, affiliates, advertising and promotional agencies, and suppliers providing any Prize or other materials and services in connection with the Contest (collectively, the "Excluded Persons"); members of the immediate families of the Excluded Persons, including brothers, sisters, children, fathers, mothers or legal or common-law spouses, and other individuals with whom any Excluded Person resides.

10. Studentawards Inc. or a representative of Studentawards Inc. will attempt to contact each selected entrant within seven (7) business days of the Contest Draw (the “Contact Date”), by e-mail at Studentawards Inc.’s sole discretion, from the information specified by that selected entrant in his or her entry form. In order to be declared the winner of the Contest: a selected entrant must be in compliance with these Contest Rules; a Studentawards Inc. employee must be able to reach the selected entrant (or if the selected entrant is a minor, his or her legal guardian) by e-mail within seven (7) business days of the Contact Date, as evidenced by a verbal confirmation or return e-mail from the selected entrant; each selected entrant (or if the selected entrant is a minor, his or her legal guardian) must first correctly answer a mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise; and each selected entrant (or if the selected entrant is a minor, his or her legal guardian) must complete, sign and return a declaration of compliance and liability release prepared by Studentawards Inc. by the return date specified by Studentawards Inc. confirming compliance with the Contest Rules and acceptance of the Prize as awarded, and releasing Studentawards Inc., its affiliates and sponsors from all liability. Should a selected entrant not be reached within a seven (7) business day period from the Contact Date, for any reason, including, but not limited to, the fact that a selected entrant did not provide a functioning e-mail address, or if, that selected entrant is unable to answer the skill-testing question or does not meet all of the Contest conditions, the Prize shall be automatically forfeited by that selected entrant. In such event, another draw shall then be conducted where one (1) Entry Form will be drawn at random from among all remaining eligible entries received during the Contest Period. A Studentawards Inc. employee will attempt to contact the new selected entrant within seven (7) business days of the time at which such entrant was selected, by email or telephone, and subject to the same conditions as set out in this clause and in these Contest Rules. This process will be repeated until sufficient entrants are declared Contest winners or until no Entry Forms remain. Subject to Section 13, no e-mail or telephone contact will be made or any other correspondence sent to any Contest entrants regarding who is(are) the winner(s) of the Contest other than to the selected entrant(s).

11. If a selected entrant or declared winner is not in compliance with these Contest Rules, Studentawards Inc. reserves the right to disqualify such entrant from the Contest.

12. By entering the Contest, each Contest winner grants Studentawards Inc., its affiliates and suppliers of the Prize and other affiliated companies involved in the Contest (the "Contest Sponsors"), their respective agents and representatives unlimited use of his or her name, address, voice, photograph, statements and/or likeness in any and all media without remuneration throughout the world in perpetuity for the purpose of advertising and/or promotion.

13. Each Contest winner (or if the selected entrant is a minor, his or her legal guardian) must sign a declaration of compliance and liability release prepared by Studentawards Inc. confirming compliance with all Contest rules and confirming his or her release of the Contest Sponsors and their respective associates, affiliates, subsidiaries, directors, officers, shareholders, employees, contractors, agents and representatives and their respective advertising and promotional agencies (the "Releasees") from any and all liability arising in any manner out of the Contest, including, without limitation, the selection of any Prize winner, the administration of the Contest, and the acceptance or the use of any or all of the Prizes as awarded. Each Contest winner must return such documents signed by that Contest winner (or if the selected entrant is a minor, by his or her legal guardian) by the return date specified by Studentawards Inc.

14. Studentawards Inc. reserves the right, in its sole discretion, to terminate, close, suspend, reinstate or amend in whole or in part the Contest at any time without prior notice for any reason whatsoever..

15. All decisions by Studentawards Inc. with respect to all aspects of the Contest shall be final and binding. All entrants agree to abide by all of the instructions and decisions of Studentawards Inc. In the event of any dispute regarding the interpretation of these Contest Rules or any decision rendered by Studentawards Inc. the decision or interpretation of Studentawards Inc. shall prevail.

16. Any attempt to tamper with the entry process, to interfere with the Contest or these Contest Rules, to deliberately damage any website or to undermine the administration, security or legitimate operation of the Contest, may be a violation of criminal and civil laws and the each of the Contest Sponsors reserve the right to seek damages or other relief or both from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future Studentawards Inc. Contests.

17. All Contest entries shall automatically become the sole property of, and are subject to verification by, Studentawards Inc. and will not be returned. Any entry that is incomplete, illegible, damaged or irregular, or that contains false information is invalid.

18. The Releasees shall not be responsible for entries not received or not considered eligible due to incomplete, inaccurate, unclear or indecipherable information, failed or interrupted network connections or other mechanical or technical problems, however caused, (including a busy phone signal). The Releasees shall have no liability for lost, stolen, delayed, damaged or misdirected Entry Forms or for any failure, interruption, delay, error or omission of the Studentawards Inc. websites (the "Website") or features on the Website during the Contest, for any problems related to the Website, including mechanical or technical malfunction of, or damage to, any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, for failure of any email or Entry Form to be received by Studentawards Inc. for any reason, for damage to an entrant's or any other person's computer, or for breaches of privacy for any reason beyond the control of the Releasees, including interference by third party computer "hackers".

19. By entering the Contest, each entrant agrees to abide by these Contest Rules, which are subject to change without notice to Contest entrants individually and which changes shall be posted at this page of the Website. By entering the Contest, each entrant automatically releases each of the Releasees and any other person or entity associated in any way with the Contest from any and all liability arising in any manner out of the Contest, including, without limitation, the selection of any Prize winner, the administration of the Contest, and the acceptance or the use of any or all of the Prizes as awarded.

20. Each Contest Sponsor does not and will not assume responsibility of any nature whatsoever in all cases where the inability to hold the Contest results from any event beyond the reasonable control of Studentawards Inc. including, without limitation, a fortuitous event or irresistible force, any public health emergency or medical quarantine, any strike, lock-out or other labour conflict in any establishment.

21. By entering this Contest, you consent to Studentawards Inc. using the personal information submitted with your entry both for the purpose of administering the Contest and for the purposes as described in Studentawards Inc.’s Privacy Policy.

22. By specifically checking an additional Contest Sponsor information check-box on the Entry Form (if available), you consent to the Contest Sponsor using the personal information submitted with your entry including, but not limited to, contacting you in the future to provide electronic newsletters and mailings, and other promotions and product and/or service offerings of the Contest Sponsor.

23. This Contest is subject to all applicable federal, provincial and municipal laws and is void outside Canada or where prohibited by law. Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario.

24. If any provision of these Contest Rules or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of these Contest Rules, or the application of such provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby and each provision of these Contest Rules shall be valid and enforced to the fullest extent permitted by law and be independent of every other provision of these Contest Rules.
